• Pre-owned and vintage items are sold in their current condition and may show signs of wear, aging, or minor imperfections

• Colors, textures, and dimensions may vary slightly from photos due to lighting, photography, and the unique nature of second-hand goods

• We are not responsible for slight variations or minor inaccuracies in product descriptions

6.2 Pricing

• All prices are listed in U.S. Dollars (USD) unless otherwise stated

• Prices are subject to change at any time without notice

• We reserve the right to correct pricing errors on our website or in orders

• Applicable taxes and shipping fees will be calculated and displayed at checkout

6.3 Availability

Because we specialize in unique, one-of-a-kind second-hand goods:

• Product availability is not guaranteed until your order is confirmed

• We reserve the right to limit quantities, discontinue products, or refuse orders

• If an item becomes unavailable after you place an order, we will notify you and issue a full refund

7. Orders & Payment

7.1 Order Acceptance

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order for any reason, including:

• Product unavailability

• Pricing or description errors

• Suspected fraudulent or unauthorized transactions

• Credit card or payment authorization issues

Your order is not confirmed until:

1. We receive payment authorization from your payment provider

2. We send you an order confirmation email

All sales are final once payment is processed, subject to our Returns & Exchanges Policy.

8. Shipping & Delivery

8.1 Shipping Policy

• We ship to addresses within the United States

• Shipping costs and estimated delivery times are displayed at checkout

• We are not responsible for delays caused by shipping carriers, weather, customs, or other factors beyond our control

8.2 Risk of Loss

Risk of loss and title for all products pass to you upon delivery to the shipping carrier. Once your order is handed off to the carrier, we are not responsible for lost, stolen, or damaged packages.

We recommend:

• Tracking your shipment using the provided tracking number

• Filing a claim with the carrier if your package is lost or damaged in transit

8.3 International Shipping

At this time, we do not offer international shipping. We may expand to international markets in the future.

9. Returns & Exchanges

Our Returns & Exchanges Policy is available on our website and incorporated into these Terms by reference.

• Returns and exchanges are accepted within 14 days of delivery (check our full policy for details)

• Items must be in their original condition, clean, and undamaged

• Certain items (final sale, intimate apparel, etc.) may not be eligible for return

• Customers are responsible for return shipping costs unless the item is defective or we made an error

For safety reasons:

• We do not accept returns on recalled or non-compliant children's products

• All children's items are screened for compliance before sale

We describe our items accurately and note known defects, but vintage and pre-owned items may show signs of wear, aging, or minor imperfections that are inherent to their second-hand nature.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• Warranties regarding the accuracy, reliability, or completeness of product descriptions

• Warranties that the Services will be uninterrupted, secure, or error-free

11.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

• Revive and Shine, its owners, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services, including but not limited to:

  • Lost profits, revenue, or data

  • Loss of goodwill or reputation

• Our total liability to you for any claim arising out of or related to these Terms or your use of the Services is limited to the amount you paid for the product(s) or service(s) giving rise to the claim, or $100, whichever is greater.

14. Dispute Resolution

14.1 Informal Resolution

If you have a dispute, concern, or complaint, please get in touch with us first at sierra@reviveandshinesolutions.org. We are committed to resolving issues in good faith and will work with you to find a fair solution.

14.2 Binding Arbitration

If we are unable to resolve a dispute informally within 30 days, you agree that any claim or dispute arising out of or related to these Terms or your use of the Services shall be resolved by binding arbitration rather than in court, except as provided below.

Arbitration Terms:

• Arbitration will be conducted in Outagamie County, Wisconsin under the rules of the American Arbitration Association (AAA)

• The arbitrator's decision will be final and binding

• Each party will bear its own costs and fees, unless otherwise awarded by the arbitrator

• You waive your right to a jury trial and to participate in a class action lawsuit

Exceptions:

• Either party may seek injunctive or equitable relief in court to protect intellectual property rights

• Small claims court is permitted for claims within the court's jurisdiction

14.3 Class Action Waiver

You agree to bring claims against us only in your individual capacity, and not as a plaintiff or class member in any purported class, representative, or collective proceeding.

15. Governing Law

These Terms and any disputes arising out of or related to these Terms or the Services shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law principles.

Any legal action or proceeding (other than arbitration) shall be brought exclusively in the state or federal courts located in Outagamie County, Wisconsin, and you consent to the personal jurisdiction of such courts.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, Returns & Exchanges Policy, and any other policies or agreements referenced herein, constitute the entire agreement between you and Revive and Shine regarding your use of the Services.

These Terms supersede any prior agreements, understandings, or representations, whether written or oral.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Revive and Shine.
